ACKNOWLEDGMENT OF RISKS, LEGAL RIGHTS WAIVER, LIABILITY RELEASE, AGREEMENT TO PARTICIPATE, AND HOLD HARMLESS AGREEMENT

Habitat for Humanity of Citrus County, Inc.

READ CAREFULLY: THIS IS A BINDING LEGAL AGREEMENT WHICH SIGNIFICANTY AFFECTS YOUR RIGHT TO RECOVER DAMAGES AND/OR SEEK OTHER LEGAL RELIEF FOR PERSONAL INJURIES AND/OR DAMAGES.

This Acknowledgment of Risks, Legal Rights Waiver, Liability Release, Agreement to Participate, and Hold Harmless Agreement (referred to hereafter as “Acknowledgment and Agreement”) is designed to cover an individual (referred to hereafter as "Participant”) with the understanding that by signing below, the undersigned attests that the Participant understands, is familiar with, and agrees with the entire Acknowledgment and Agreement contents.

In agreeing to participate during Habitat for Humanity of Citrus County's Habitat HabiBlast Clay Shoot Tournament in the use of the Tampa Bay Sporting Clays or the property commonly known as the Tampa Bay Sporting Clays in Tampa, Florida, including the discharge of firearms, Participant recognizes the risk of injury from the activity and weaponry involved is significant, including the potential for permanent disability and death, and while particular protective equipment and personal discipline will minimize this risk, the risk of serious injury does exist. Participant KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assumes full responsibility for their participation.

The Participant further authorizes Habitat for Humanity of Citrus County Inc. to seek emergency medical services in the event of an accident. In consideration for the services provided and Habitat for Humanity of Citrus County Inc. and Tampa Bay Sporting Clays allowing the Participant to participate in the activity, the Participant forever releases, discharges, and holds harmless Habitat for Humanity of Citrus County Inc., its agents, employees, officers, directors, affiliates, successors, and/or assigns ("Released Entities"), of and from any and every claim, demand, action, and/or right of action of whatsoever kind of nature, whether in law or in equity, arising from or by reason of any personal injury, known or unknown, death, and/or property damage, resulting, to result from, and/or relating to any accident and/or other occurrence which may occur as a result of the participation in the use of the Tampa Bay Sporting Clays and/or use of the property known as Tampa Bay Sporting Clays, and/or resulting from the administration of emergency medical attention, whether such injury, death, and/or damage is caused by negligence of the Released Entities or not, except that which is the result of gross negligence and/or wanton misconduct.

I, the undersigned, have carefully read the foregoing Acknowledgment and Agreement, fully understand the contents thereof, and agree to be legally bound by the terms of this Acknowledgment and Agreement. The foregoing Acknowledgment and Agreement shall be enforceable by Habitat for Humanity of Citrus County Inc., its agents, employees, officers, directors, affiliates, successors, and/or assigns.
